Apartments:
Each apartment has a fully fitted kitchen, and both bedrooms have modern state-of-the-art ensuite bathrooms. The master bedrom has a king size bed and the guest bedroom has two queen size beds. All the rooms are the air conditioned and have televisions, together with CD/DVD players. Facilities within the hotel include excellent water sports facilities, a lagoon style swimming pool, jacuzzi, Business Centre, free high-speed wireless connection, bars and restaurants. Lease: The properties are offered on a 99 year lease, but the hotel undertakes to the Government of St. Lucia every 25 years to have the Leases which underlie the Development, made up to a new 99-year term. The costs of such applications will be charged to the Rental Pool. Every such extension granted to the hotel shall automatically be reflected in an extension of the term to be granted by The Lease, however the hotel does not make any warranties or guarantees with respect to the granting of such lease extension by the Government. |

Owner Occupancy: 12 weeks: Six weeks High Season - Six weeks Low Season High Season - 15th December to 15th April each year; One week either side Easter if it falls outside this period; Second week of Jazz Festival. Low Season - Remaining period Operating Year - 1st December to 30th November. During 'Owner Occupancy' the owner can use the apartment themselves or rent it out to friends or clients, retaining the monies charged. The sofa in the living room converts to a double bed. These numbers are inclusive of children over the age of two years. Whilst the apartmet is occupied during the "Owner Occupancy" period the only charge will be US $50 per day by way of a Service Charge to cover direct costs such as, maid and linen service, guest supplies and electricity etc. This will be liable to Government Tax (10%) and Service Charge (8%). Unused Owner Ocupancy weeks in any one year cannot be carried over to subsequent years. In order to maintain room revenue, Owner Occupancy is restricted to (30%) of the room stock in any one High Season week and (40%) of the room stock during the Rest of the Year. Bookings will be accepted on a first come, first served basis and a waiting list will be established for cancellations in the event of excess demand. |

Quarterly Maintenece Charge: The owner will pay US$1,700 per quarter, quarterly in advance as a contribution towards the costs of electricity and maintenance of grounds and pools, 'All Perils' Building Insurance, including Third Party Liability and Contents Insurance, Property Taxes, Security, and an Asset Replacement Reserve. Any subsequent increases are capped to the annual inflation rate of the aforesaid items. Profit Share: When the Owner is not using their apartment it will be incorparated into the hotel programme. each two bed apartment, by a system of 'shut-offs', splits down into a deluxe hotel room and a one bed room suite. Profits from the hotel rental programe will be split between the hotel and the apartment owners.Bay Garden Beach Resort will attend to all the management, marketing and maintenance issues. The Owners Share of Profits” will be 60% of the ‘Net Rooms Division Profit’. The ‘Net Rooms Division Profit’ is defined as Total Room Rental revenues, net of Government Taxes and Service Charge, less costs directly attributable to the Rooms Division department, which will include payroll (e.g. housekeeping, reception, reservations etc.); electricity, water and sewage, Security, Grounds & Property Maintenance, Sales & Marketing, Property Insurance, Property Taxes and an Asset Replacement Reserve. For the avoidance of doubt it does not include revenue or costs associated to the restaurants, bars and beach facilities. In the event that the Owner’s Share of Profits is a negative sum (a loss) in any year, The Owner’s will not be required to pay any contribution to the loss, but the loss will be carried forward and be deducted from any future profits prior to any future distribution Owner’s Share of Profits. Calculation of the Owner’s Distribution Account shall be made annually on the basis of audited account and distributions shall be made within ninety (90) days following the end of the Operating Year. If the distribution is not made within the said ninety (90) days, the hotel shall pay interest on such sum at the rate of 6% per annum until payment.
Reservation Fee (Non Refundable) – US$5,000.00 Taken on Visa or Mastercard and secures the unit for 30 days.First Contract Payment – 50% less Reservation Fee, payable within 30 days of signing reservation agreement and at the time of signing the Agreement to Purchase.Second Contract Payment – 45% of sales price due within 60 days of signing the reservation agreement. Third Contract Payment – Balance of 5% on Handover, once the Alien’s Landholding Licence (if required) has been rec’d.
